Rules and Conditions
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
The “Crystal Geyser Sparkling "New Flavor" Contest is sponsored by Crystal Geyser Sparkling (“Sponsor”). This contest is governed by these official rules (“Official Rules”). By participating in the contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the contest, as determined by Sponsor are final in all respects. The contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. Any questions, comments or complaints regarding the promotion should be directed to Sponsor, and not to Facebook, Instagram or Twitter.
- Promotion Description.
This promotion is sponsored by Crystal Geyser Sparkling (“Sponsor”) and is open to residents of the United States. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. You are providing your information to Crystal Geyser Sparkling. Subject to Paragraph 8 below, the information you provide will only be used for choosing the winners and offering you promotional items from Crystal Geyser Sparkling.
- Eligibility.
This Promotion is open only to Facebook, Instagram and Twitter Users, who are residents of the United States, eighteen (18) years of age or older at the time of entry and, who have Internet access and a valid e-mail account prior to the beginning of the Promotion. Sponsor has the right to verify the eligibility of each entrant. Employees of Crystal Geyser Sparkling and their parent and affiliate companies and advertising
and production agencies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee or entity are not eligible to participate in this Contest. Only one entry per individual will be accepted, and multiple
entries will be disqualified.
- Contest Period.
The Contest begins November 2nd, 2021 at 12:00 p.m. PST and ends November 6th, 2021 at 11:59 p.m. PST. (“Contest Period”). All entries must be received on or before 11:59 p.m. PST on November 6th, 2021. Sponsor reserves the right to extend or shorten the contest at its sole discretion.
- How to Enter
There is one way to enter this promotion. On November 2nd, 2021 at 12:00 p.m. PST individuals can log on to the Crystal Geyser Sparkling Facebook, Twitter, and Instagram page, and comment on what they think is the next flavor for Crystal Geyser sparkling launch on the Contest Announcement Post.
All entries become the property of Sponsor(s), and Sponsor(s) reserve(s) the right to use any information submitted by entrants as set forth in Paragraph 1. Entries must be filled out completely and legibly in order to qualify, and will be void if they are, in whole or in part, incomplete, illegible, damaged, irregular, counterfeit, altered, or obtained through theft or fraud. The use of inappropriate photos such as but not limited to using profanity, nudity or any other element Crystal Geyser Sparkling representatives deem inappropriate will be immediately removed and contestant will be disqualified. No mechanically reproduced, software-generated or other automated multiple entries are permitted unless it’s through the custom tab. Sponsor(s) is/are not responsible for lost, late, illegible, misdirected or mutilated entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or Sponsor(s), telephonic failures, human error, or any other error or malfunction. For online entries, the authorized account holder of the e-mail address submitted at time of entry will be considered the entrant. An “authorized account holder” shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. A potential winner may be requested to provide proof that he or she is the authorized account holder of the e-mail address associated with a winning entry. Entrants agree not to upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any web site or undermine the operation of the promotion is a violation of criminal and civil laws, and Sponsor(s) reserve(s) the right to seek damages from any person who makes such attempt(s). Entry materials that have been tampered with or altered are void. Any questions regarding the number of entries submitted by an individual or the authorized account holder of an e-mail address shall be determined by Sponsor(s) in its/their sole discretion, and Sponsor(s) reserve(s)
the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the promotion.
- Grand Prize
Posts will be accepted until November 6th, 2021 at 12:00 p.m. PST, during the Contest Period. The public (Facebook, Twitter or Instagram users) will be invited to comment on the Crystal Geyser Sparkling Contest Announcement Post for a chance to win a $25 Amazon gift card or 6 x 1.25L bottles of our newest sparkling flavor. The first two correct respondents will receive a $25 Amazon gift card and, three runner-ups get 6 x 1.25L bottles of our newest flavor
- How the Prize will be Awarded.
5 total Winners will be chosen if they are to guess our new sparkling flavor correctly. Winners will be notified through Facebook, Twitter or Instagram and prizes will be mailed to winners upon approval of contest entry.
- Odds of Winning.
The odds of winning depend on whether or not the consumer can guess the correct flavor.
- Conditions of Acceptance of Prize.
Prize will be sent via US Postal Services, Fedex or UPS for all US entries or electronic through email. Crystal Geyser Sparkling cannot guarantee any time of delivery for prize. Winners will be informed of shipping and tracking information upon mailing of prize. Prize(s) may not be exchanged for cash or any other consideration. To the extent permitted by law, participation in this contest constitutes each winner’s consent to Crystal Geyser Sparkling and all other sponsors and venues, right to publicize and broadcast the winner’s name, contest photo submission, and likeness, the fact that he or she won, and all matters incidental thereto, for promotional purposes in any media, worldwide, without further payment or consideration.
- Limitation on Liability.
By entering this promotion and to the extent permitted by law, each entrant forever discharges and releases Sponsor(s), Facebook, Instagram, Twitter and its
parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from any and all liability, claims, causes of action, suits, and demands of any kind arising from or in connection with the promotion, including, without limitation, responsibility for property damage, loss of life, or personal injury resulting from or in connection with participating in the promotion or from or in connection with use or receipt of the prize(s), however caused.
- Sponsor’s Reservation of Rights.
These official rules are subject to modification by Crystal Geyser Sparkling. In the event of a dispute, all decisions made by Crystal Geyser Sparkling are final and binding. Sponsor(s) reserve(s) the right, in its/their sole discretion, to disqualify any person who tampers with the entry process or voting process, or who otherwise acts in violation of these official rules. Sponsor(s) further reserve(s) the right, in its/their sole discretion, to cancel, terminate, or modify this promotion if, for any reason, the promotion is not capable of completion as planned, including due to infection by computer virus, technical corruption, force majeure, or non-authorized human intervention that compromises or affects the administration, fairness, integrity, security, or proper conduct of the promotion.
- Disputes
To the extent permitted by law, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the appropriate California State Court located in San Francisco County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
